President Trump plans to issue an order on his first day in office, today, that will define a person’s gender strictly as “male or female.” The directive will mandate that government agencies adhere to this “immutable” classification when issuing forms and identification documents. It will also call for significant changes to federal prison policies regarding transgender inmates.

“What we’re doing today is defining that it is the policy of the United States to recognize two [genders]: male and female. These are [genders] that are not changeable, and they are grounded in fundamental and incontrovertible reality,” an incoming White House official explained during a briefing with reporters.

This initiative is part of a broader executive order, one of many that Trump, 78, is expected to sign shortly after taking the oath of office at noon.

Under the new policy, individuals will no longer be allowed to change the gender designation on U.S. passports, which currently offer options for male, female, or “X.” The order also aims to prohibit transgender inmates from receiving medical transition treatments while incarcerated. Both measures are anticipated to face legal challenges.

The order will further direct federal agencies, including the State Department and Department of Homeland Security, “to ensure that official government documents, including passports and visas, reflect [gender] accurately,” according to the incoming administration official.
