Special Counsel Jack Smith filed a motion on Monday to drop four charges previously brought against President-elect Donald Trump in connection to alleged efforts to undermine the 2020 election results.

Smith based his request on Trump’s recent win in the 2024 presidential election and longstanding legal precedent that discourages indicting a sitting U.S. president. He asked the court to formally dismiss the charges against Trump, who will soon assume office as the 47th president.

“It has long been the position of the Department of Justice that the United States Constitution forbids the federal indictment and subsequent criminal prosecution of a sitting President,” stated Smith’s team in their legal submission.

The charges originally included conspiracy to obstruct an official proceeding, obstruction of and attempt to obstruct an official proceeding, conspiracy against rights, and conspiracy to defraud the United States.

Reports indicate that Smith had already begun preparing to conclude his investigations into Trump’s actions and was planning to step down before January 20, 2025, when Trump is set to be inaugurated again and could potentially remove him from his position.
