The Guatemalan national accused of torching a sleeping passenger on the F train and watching as she was fatally burned allegedly slipped back into the United States after a prior deportation—only to later make use of New York City’s shelter system, The NY Post reports.

Sources indicate that his first appearance in the United States occurred at the Arizona border in 2018. At that time, he was apprehended and sent out of the country within days for unlawful entry, according to multiple accounts shared with The Post.

He is believed to have crossed into the U.S. again at some undisclosed later date, avoiding federal authorities. It is unclear how long he has been living in New York.

Nonetheless, law enforcement contacts say he resided in multiple publicly funded shelters designated for migrants within the city.

He reportedly presented the address of a Randall’s Island shelter in 2023 when provided with a transit pass, sources stated.

According to these same sources, the suspect does not seem to have any other criminal record.
